⚠ Applies to All Transactions — This Fee Is Not OptionalThis fee is not optional. Ohio law authorizes dealers to include a documentary service charge on every retail or wholesale sale or lease of a motor vehicle. The fee is a standard part of the transaction and is always disclosed in writing on your purchase agreement prior to signing.
Ohio Revised Code § 4517.261 expressly authorizes every licensed motor vehicle dealer to charge a documentary service charge on any retail or wholesale sale or lease of a motor vehicle. What Is a Documentary Service Charge?
A documentary service charge — commonly referred to as a “doc fee” — compensates the dealership for the significant administrative and legal compliance work required to complete every vehicle sale or lease in Ohio. Every transaction involves extensive paperwork and regulatory obligations imposed by both state and federal law.
The charge is a single flat fee specified in writing on your purchase agreement. Ohio law does not require itemization of individual services, but the work it covers includes:
- Title application & processing
- Federal Truth-in-Lending disclosures
- State registration filings
- FTC Buyers Guide compliance
- Odometer disclosure compliance
- Retail installment contract prep
- Lien & lienholder filings
- Consumer privacy notices
- Sales tax documentation
- Red Flags Rule compliance
- Ohio BMV title records
- Records retention obligations
Why Ohio Law Permits This Charge
The Ohio General Assembly enacted R.C. § 4517.261 recognizing that selling or leasing a motor vehicle is one of the most heavily regulated consumer transactions in the state. Dealers must comply with requirements from the Ohio Bureau of Motor Vehicles, the Ohio Attorney General’s Consumer Protection Section, the Federal Trade Commission, and multiple federal consumer lending laws.
Rather than requiring dealers to itemize dozens of individual compliance costs, the law allows a single, transparent, capped fee disclosed uniformly across all transactions. This protects consumers through price certainty while allowing dealers to recover legitimate administrative costs.
Effective October 24, 2024, Ohio Senate Bill 94 updated the maximum from $250 to an inflation-adjusted rate — currently $398 or 10% of the vehicle’s cash price, whichever is lower. The Ohio Registrar of Motor Vehicles publishes an updated maximum on the last day of September each year.
Our Commitment to Transparency
